The Law West of The Pecos

I am not a lawyer, nor have I ever been a lawyer, but in the fifty or so years I have been working in the Arts I have stumbled over a lot of law stuff. Now you probably remember my three day blather over derivatives and you're glad that's over, but just in case you didn't get enough and can't live without more, I have good news...

The first item up for further discussion is copyrights. What again? Yes, and yes again until we have beaten that dead horse into the ground. Better to be educated than to wind up in court. Back in Tejas we have a saying, "No man's life and liberty is safe, while the Legislature is in session." It ain't Texas but it's still true, "No man's life and liberty is safe while there are lawyers circling the count house." Get the facts and be sure you are safe so that the legal system doesn't offer you some American Justice.

And while we're at it, take another look at the article about model releases. Sure you've never needed one and probably never will, but can you take that chance? I just read an article suggesting that all creative folks should carry liability insurance. Seems to me getting a release is much cheaper and simpler and if you are going to use a person's image in your picture, then it should a minor thing to get them to sign a release.

Just because it is called Stock Photography don't go away mad. In fact it should be called stock images, cause you see that's what they are. And because of that it is entirely possible that a painter or sculpture or wood carver might just have an image worth licencing. It's worth a read and this is one of the best articles I have come across on the business of Stock Images. Ron-Bob says, "Check it out!"
